E-2 Visa Applicant Checklist
- Must be a citizen of a treaty country.
- Must be coming to the U.S. to develop and direct their business.
- May hire citizens of the treaty country as executives, supervisors or essential and skilled employees for the business.
- Must have invested a significant amount of capital over which they had possession and control.
- The funds must be irrevocably committed and at-risk.
- The business must be real and operating or able to begin operations immediately upon issuance of the visa.
- The business must not be marginal.
